Partner

Patrice Racicot is a partner. For more than twenty years, he has acted as counsel for institutions and bankruptcy trustees in matters involving restructuring, insolvency, and banking law. He also represents clients in the areas of commercial litigation and injunctions.

Mr. Racicot regularly advises and represents the Canada Mortgage and Housing Corporation (CMHC) in matters involving the insolvency of seniors’ residences and other areas where the CMHC acts as lender or insurer. Mr. Racicot also represents the CMHC in matters involving securitization.

Mr. Racicot acts as counsel for major bankruptcy trustees and the National Bank of Canada in matters involving restructuring, insolvency, and banking law. He has thus represented bankruptcy trustees and receivers, particularly in the area of restructuring mining companies and firms selling goods and services. The National Bank of Canada has retained him for important insolvency cases, particularly in the agricultural sector and cases involving hog production.

A substantial part of Mr. Racicot's practice is devoted to representing companies and individuals before the courts in commercial litigation, fiduciary matters, and proceedings for injunctive relief.

In 1992, Mr. Racicot was awarded the Harry Batshaw Prize for excellence in civil liberties by the law faculty of Université de Montréal.

Lecture

Mr. Racicot regularly offers training sessions in legal matters to his clients.

On September 19, 2007, as part of the Seventh Annual Conference on Securities organized by Insight Information, Mr. Racicot spoke about lending agreements and the factors to consider in case of default.

On January 29, 2008, during the Conference on Financing and Securities  organized by the Canadian Institute, Mr. Racicot spoke on “The exercise by a mortgagee of its rights and the difficulties that may arise from the application of the Farm Debt Mediation Act”
