  1. Luc Thibaudeau publishes the 2nd volume of the Guide pratique de la société de la consommation – Les Garanties

    On March 28, 2018, Luc Thibaudeau, a partner of the Litigation and Conflict Resolution group, launched the second volume of his Guide pratique de la société de la consommation on warranties. The event, which took place at the Lavery Conference Centre, welcomed more than 100 guests. The publication is not only intended for lawyers working in consumer law in Quebec, but also for the general public. Mr. Thibaudeau addresses the different types of warranties that apply to goods and services intended for consumption, while drawing many parallels with the warranties of common law. The author's analysis captures both the rationale and the limits of consumer protection as regards warranties. His expertise in this field has been recently recognized by his nomination to the Consumer Protection Advisory Committee. Members will provide input on the evolving nature of the financial sector and consumer needs by sharing their perspectives on marketplace trends and emerging issues, concerns regarding the delivery of financial services, and how changes in the financial services sector are impacting Canadians.  For more information or to buy the book, click here.

  2. Lavery takes part in the 5th edition of Pro Bono Québec’s Grands Vins, Grands Noms benefit evening

    On February 8, 2018, several partners and lawyers represented Lavery at Pro Bono Québec’s Grands Vins, Grands Noms benefit evening for access to justice for all. The cocktail dinner, hosted at the McCord Museum, brought together some 250 VIPs who helped collect more than $131 600 during a silent auction. Lavery, an ambassador and sponsor of this charity dinner since its very beginnings, also contributes to Pro Bono Québec’s mission through Bernard Larocque, a partner who serves as the Vice-Chair of the Board of Directors, Luc Thibaudeau and Maude Adam-Joly, respectively a partner and an associate with the Litigation and Conflict Resolution group. Proceeds from the Pro Bono Québec benefit evening will help with the renewal of its programs and the creation of new ones. Founded in 2008 at the behest of the Barreau du Québec, Pro Bono Québec is a non-profit organization, whose mission is to mobilize the legal community in providing expertise and offering their time to individuals and Quebec NPOs who lack the resources required for legal services.

  3. Brigitte Gauthier and Luc Thibaudeau provide training for counsel at the NBC

    Brigitte Gauthier and Luc Thibaudeau, associates in the Business Law and Litigation groups, respectively, are providing a series of three training sessions for counsel at the National Bank of Canada on the impact of the Act mainly to modernize rules relating to consumer credit and to regulate debt settlement service contracts, high-cost credit contracts and loyalty programs (the “Bill”). At the sessions, Ms. Gauthier and Mr. Thibaudeau work with National Bank of Canada lawyers on analyzing the various issues that arise under the new provisions of the Consumer Protection Act in relation to consumer credit, and other amendments to the Act proposed in the Bill. The first two sessions were held this past December and January, and the next will take place on March 1. Other meetings are planned to take place after the Government publishes the new regulations that will be put in place once the Bill comes into force.

  4. Lavery represents Aspen Skiing Company and KSL Capital Partners in a US$1.5 billion acquisition

    As legal advisors for the Quebec portion of the transaction, Lavery represented the affiliates of Aspen Skiing Company, LLC and KSL Capital Partners, LLC during the acquisition of Intrawest Resorts Holdings, Inc., a ski resort operator and adventure company in North America that owns Mont Tremblant Resort in Quebec. The transaction closed on July 31, 2017, for an approximate aggregate value of US$1.5 billion and created a new entity with a property portfolio of 12 four-season mountain resorts, 20,000 skiable acres, significant land available for real estate development, and Canadian Mountain Holidays, a leading heli-ski operator. The Lavery team was headed by Sébastien Vézina and François Arseneault (Corporate) and included Carole Gélinas and Mathieu Cantin (Real Estate), Audrey-Julie Dallaire and Daniel Bouchard (Environment), Zeïneb Mellouli (Labour), Eric Lavallée (Intellectual Property) and Maxime Rousseau-Turenne and Luc Thibaudeau (Litigation).

  5. Luc Thibaudeau receives an award for engagement from Éducaloi

    Luc Thibaudeau, a partner of the Litigation and Conflict Resolution group, received an award for his engagement from Éducaloi during their annual meeting held on June 6 at the Maison du Barreau. The award recognizes Mr. Thibaudeau’s involvement with the organization, in particular the many times he has delivered Éducaloi workshops in high schools. Éducaloi is a registered Quebec charity that has been playing a leading role in improving access to justice since it was founded in 2000. Its mission is to inform the public about the law and their rights and obligations. To achieve this, it carries out activities in three areas: legal information, legal education and developing an expertise in explaining the law in plain and simple language.

  6. Associate Laurence Bich-Carrière and partner Luc Thibaudeau, of the Litigation and Conflict Resolution group, wrapped up the Cycle de conférences 2016-2017 organized by the Fondation Claude-Masse with a presentation on “Le mythe de Sisyphe et le consommateur heureux: la nécessité d'une législation efficace en matière de crédit à la consummation”. Held at the Université de Montréal Faculty of Law on April 12, the conference cycle discussed the myths and mysteries surrounding consumer law. Ms. Bich-Carrière and Mr. Thibaudeau reviewed the bases and functioning of modern consumer credit mechanisms measured against the statistical reality of Canadian consumer debt level, and sought to identify avenues to allow access to responsible consumer credit while ensuring that the consumer goods and services sector remains financially healthy and functions effectively.

  7. Luc Thibaudeau interviewed in Lawyers Weekly regarding the Quebec Court of Appeal ruling regarding the Mazda Canada Inc. class action suit

    Luc Thibaudeau, a partner at Lavery who specializes in consumer law and represents a wide range of clients including corporations, financial institutions, retail chains and stakeholders in the entertainment industry, is quoted several times in Luis Millan’s article “Mazda ruling viewed as consumer win” published in the February 26, 2016, edition of Lawyers Weekly. In the article, the decision is “hailed as a victory for consumers” that “bucks the nationwide growing trend against economic loss based tort claims,” and summarizes Mr. Thibaudeau’s opinion as follows: “But the ruling does have a silver lining for manufacturers” since “[it] underscores the importance for manufacturers to act as soon as they discover their products have a latent defect […] By refusing to award punitive damages against Mazda, the appeal court recognized that the carmaker made an effort to remedy the situation when it launched its service campaign.” To read the full article, please click here.

  8. Luc Thibaudeau quoted in an article from the Journal du Barreau du Québec

    Luc Thibaudeau, a Litigation partner at Lavery, was quoted in an article from the September 2015 issue of the Journal du Barreau du Québec.The article entitled “Débats sur la langue - Quelles réformes à venir sur l’affichage?” (Language debate - What are the coming reforms for displays?), analyzes legislative modifications that might occur in the Charter of the French Language this fall, and might have an effect on retailers’ displays which, following a recent Quebec Court of Appeal ruling, can be in English. On that subject, Mr. Thibaudeau gives precisions regarding the constitutional issues such provincial legislative changes can bring, while trademarks are of federal jurisdiction.   9. The Young Bar Association of Montreal launches the 2015 edition of the Legal IT conference

    Zeïneb Mellouli, lawyer in the Labour and Employment Law Group at Lavery, is the acting Director responsible for the organizing committee of Legal IT 2015, which will take place at the Montreal Science Center on March 30, 2015. Organized by the Young Bar Association of Montreal for close to 10 years, it is now the most important conference in Canada discussing the impact of information technologies as well as their potential for law. Moreover, Luc Thibaudeau, a Litigation partner at Lavery, will be giving a conference entitled «  Le consommateur dans les nuages et la LPC : Navigation protégée » [The consumer in the cloud and the CPA : protected navigation], which will discuss the application of the Consumer Protection Act in the field of new technologies. This event gathers close to 200 participants annually and offers up to 7 hours of certified continuing legal education for the Quebec Bar.   10. Pro Bono Québec's GRANDS VINS GRANDS NOMS fundraiser event: a resounding success!

    On February 11, 2015, was held the second edition of “GRANDS VINS GRANDS NOMS”, organized by Pro Bono Québec, an organization supported by Lavery since its very beginnings. Over 200 people took part in this event, including Mr. Bernard Larocque, a Litigation partner at Lavery and Treasurer of Pro Bono Québec, and Mr. Luc Thibaudeau, a Litigation partner at the firm, who was also a member of the volunteer musical group that played during the evening. Thanks to the involvement of several lawyers of the firm as well as leading figures from the legal, arts and business community, the event was a resounding success, raising over $65,000 for this organization!
