  6. Lavery announces appointment of Simon Clément as managing partner of its Québec City office

    Lavery is pleased to announce the appointment of Simon Clément as managing partner of Lavery’s Québec City office. In addition to managing Lavery’s Québec City office, comprised of 44 professionals and employees,Mr. Clément will be responsible for the overall growth of the firm’s activities and the firm’s position in the Québec City area. As such, he will be joining the firm’s Management Committee. A professional known in the business community for his expertise and drive Mr. Clément’s practice extends to commercial litigation, including shareholder conflicts, corporate reorganizations and insolvency, breach of contract and urgent proceedings. He also offers legal counsel to long-term clients for acquisitions as well as sales of businesses and assets, in particular. In keeping with this, he chairs the Québec City division of the M&A Club, founded in 2012 to facilitate deal making and financing in the mid-market private sector between M&A professionals. “Lavery is more than a century old and has strong roots in Québec City. With its reputation well established, the firm has reinvented itself over time through bold decisions.   8. A Lavery team to train members of the COMBEQ in 2018 on wetland issues

    Throughout 2018, Daniel Bouchard, a partner, along with Valérie Belle-Isle, Chloé Fauchon and Pier-Olivier Fradette, associates of the Public and Administrative Law group, will train members of the Corporation des officiers municipaux en bâtiment et en environnement du Québec (COMBEQ). The seminar is entitled “Milieux humides et hydriques et certificat d’autorisation : quel rôle pour les municipalités ?” and is intended primarily for environmental municipal officers, as well as other municipal workers. It deals with the practical impact of Bills 102 and 132 adopted in 2017 respecting the conservation of wetlands and bodies of water. The training will be offered to all municipalities in the province and will be delivered in 24 cities over the course of the year.

  9. Lavery holds a seminar on the impact of recent amendments to the Environment Quality Act on the work of environmental consultants

    Lavery held a seminar on the impact and extent of recent amendments to the Environment Quality Act (EQA) on the work of consultants. The seminar was held on November 8 at the Lavery Conference Centre in Montréal. Environmental consultants listened to presentations by Daniel Bouchard and Chloé Fauchon, respectively a partner and a lawyer of the Public and Administrative law group, on amendments to the EQA that expanded the right to access authorization certificates granting the Minister the power to stop an activity without compensation and immunity from liability, except in cases of gross or intentional fault. They discussed these themes in light of the recent case law on the state’s liability in environment matters and offered practical suggestions to consultants on how to protect themselves given the changes.

  10. Lavery represents Aspen Skiing Company and KSL Capital Partners in a US$1.5 billion acquisition

    As legal advisors for the Quebec portion of the transaction, Lavery represented the affiliates of Aspen Skiing Company, LLC and KSL Capital Partners, LLC during the acquisition of Intrawest Resorts Holdings, Inc., a ski resort operator and adventure company in North America that owns Mont Tremblant Resort in Quebec. The transaction closed on July 31, 2017, for an approximate aggregate value of US$1.5 billion and created a new entity with a property portfolio of 12 four-season mountain resorts, 20,000 skiable acres, significant land available for real estate development, and Canadian Mountain Holidays, a leading heli-ski operator.   15. Daniel Bouchard and Sarah Leclerc discuss environmental law

    On June 10, 2016, Daniel Bouchard, Managing Partner of the Quebec City office gave a presentation as part of the 2016 edition of the training event ‘Recent developments in environment’. His conference was a summary of the article "Reflection on the underutilized municipal authorities in environment" he recently co-wrote with lawyer Sarah Leclerc, contributing to the following book  recently published by Les Éditions Yvon Blais : "Thinking about the underutilization of municipal authorities in environment", clearly states the view of its authors. Indeed, despite the decentralization of powers regarding local management causing the expansion of municipal jurisdiction, including that of environmental protection, civil society seems doomed to suffer the discretionary choice of elected officials in this matter. The article offers an insight on the importance and usefulness of the powers of elected officials in this area in addition to giving examples of these opportunities not seized by elected officials. The authors also make recommendations seeking to propose ways to potentially resolve this urgent problem." A significant component of his practice is devoted to Health Law and Regulatory and Public Law, and he has developed a thorough understanding of the legal framework of health services, addressing regulatory, contractual and commercial concerns.   19. Daniel Bouchard presents two seminars at the ADMQ Annual Conference

    The Annual Conference for the Association des directeurs municipaux du Québec (ADMQ) took place at the Québec City Convention Center from June 17 to June 19, 2015. On this occasion, Daniel Bouchard, Managing Partner of Lavery’s Quebec City Office and lawyer specialized in the fields of municipal, environmental and administrative law, presented two seminars. The first one, on June 18, was presented to about 50 municipal directors. Entitled “Nuisances et pollution, les municipalités peuvent agir!” (Nuisances and pollution, municipalities can act!), he discussed the powers of a municipality on the matter, as well as its limits, while highlighting the importance of a regulatory municipal intervention to ensure a healthy and harmonious community life. On June 19, before over 150 municipal directors, Mr. Bouchard presented “Les dernières modifications legislatives” (The most recent legislative modifications), where he discussed the recent legislative modifications relating to the new municipal governance on local and regional developments, as well as the introduction of a definition for the term “watercourses” in the Protection Policy for Lakeshores, Riverbanks, Littoral Zones and Floodplains, the amendment to the Act Respecting Municipal Courts or to the Act Respecting Compensation Measures for the Carrying out of Projects Affecting Wetlands or Bodies of Water.

  26. Daniel Bouchard of Lavery speaks on contract management for the Fédération québécoise des municipalités (FQM)

    On November 20, Daniel Bouchard, Managing Partner of Lavery’s Quebec City Office and lawyer specialized in the fields of municipal, environmental and administrative law, gave a web conference for the Fédération québécoise des municipalités (FQM) under the theme of “Contract Management Policy: Reminders and Status Report” (Politique de gestion contractuelle : rappels et état de la situation). During his discussion-type conference, Mr. Bouchard moderated a discussion regarding the contract management policy that every municipality must adopt under Article 938.1.2 of the Code municipal (C.M.), or under Article 573.3.1.2 of the Loi sur les cités et villes (L.C.V.).  He highlighted which contracts fall under said policy, the minimum measures it must contain, how it must be distributed and the possible sanctions that could be imposed on elected representatives or public officials if the policy is not respected, either under Article 938.4 C.M. or under Article 573.3.4 L.C.V. Mr. Bouchard focused especially on how best to implement such a policy and the requisite monitoring actions. Based on jurisprudence and doctrine, he also discussed policy impact on the wording of municipal contracts and on the content of calls for tender in particular.
