Last May 3, Evelyne Verrier, a Lavery partner, gave a presentation during a workshop on case law highlights in life and disability insurance over the past year, at the 2012 Canadian Life and Health Insurance Association’s Claims Section Annual Conference.
The workshop dealt mainly with the following topics: misrepresentation, burden of proof, designation of beneficiaries, duty to inform and duty to advise, contract interpretation, action in damages, and definition of disability. Ms. Verrier frequently appears before the courts in disputes concerning life and disability insurance, and damage insurance. She also has expertise in the distribution of financial products and services.

Guillaume Lavoie, a lawyer with Lavery, will be giving the members of the Fondation du maire a one-day training on shareholders’ agreements and the potential issues arising from the rights and powers provided to the shareholders of a start-up company and the adoption of the rules regarding the management of such company, next June 14. The non-profit organization supports young Montréal companies through grants and various services like this free training seminar. Mr. Lavoie evaluates applications submitted to obtain a grant from the foundation and carries out various coaching activities for the foundation’s training program in order to help business members of the foundation who are seeking expertise and advice in business law.

“Managing Agent Misconduct,” such is the title of the conference that Dina Raphaël and Philippe Frère, both partners at Lavery, will give in the context of the 2012 Compliance and Consumer Complaints Annual Conference, organized by the Canadian Life and Health Insurance Association (CLHIA). SME owners and administrators are offered the opportunity to attend two seminars on governance thanks to a partnership between Lavery and the Institute for governance of private and public organizations, a partnership in which the Fonds de solidarité FTQ, BDC, Investissement Québec, and RCGT also take part.
The role of the expertise committee is to reflect on ways to help non-listed SMEs develop a better governance structure. The theme of the first seminar is how to build and manage a good SME board of directors or advisory committee. André Laurin, a Lavery partner, will act as trainer for the second seminar, on how to improve one’s performance within a board of directors. Both activities are in French.

Ian Rose, Partner at Lavery, will give a presentation about Secondary Market Recourses under the various Canadian Securities Acts (e.g. Bill 198), at the Third Edition of the Conférence sur la Responsabilité des Administrateurs et Membres de la Direction (Directors’ & Officers’ Liability Conference), to be held in Montreal next May 15 and 16. The event, organised by Federated Press, is intended, among others, for business directors, officers and managers who wish to update their knowledge in terms of “droit corporatif et régie d’entreprise”.

On Wednesday, April 4, 2012, over 70 people attended a special event entitled “The Aboriginal Communities and the Plan Nord”, organized by the firm’s Energy and Natural Resources Group in collaboration with Groupe-conseil Entraco for the benefit of representatives from businesses that are interested in the opportunities created by the Plan Nord. On this occasion, Grand Chief Matthew Coon Come, from the Grand Council of the Crees, presented the aboriginal community’s view of the Plan Nord. Richard Dolan, partner and Chairman of the Board of Lavery, and Louis Archambault, President of Groupe-conseil Entraco and an expert in aboriginal and environmental affairs, among others, sat at the head table. The event, which was followed by a cocktail, was held at the Lavery Conference Centre.

Michel Servant, a partner at Lavery, will be the President of the Prix Relève d’Excellence 2012 Committee of Réseau HEC Montréal. Dina Raphaël, a partner in the firm’s Litigation Group, was a guest speaker for a lecture on the online sale of damage insurance products, March 15. The presentations, which were held in the context of the “Journée de l'assurance de dommages 2012” (Day of damage insurance 2012), mainly intended to clarify the issues raised by the online sale of damage insurance in the absence of a regulatory framework.

Once again, Jean Saint-Onge, partner at Lavery, is the organizer and moderator of the Continuing Education Seminar of the Quebec Bar, which this year is called “Class Actions: Recent Developments in Québec, in Canada and the United States”. The event, which is to be held March 15th and 16th at the Palais des Congrès de Montréal, features no less than 35 speakers from several jurisdictions in North America. Anne-Marie Lévesque, also from Lavery, will do a presentation on recent class action judgments in Québec.

Bernard Larocque and Jonathan Lacoste-Jobin held a conference on the Annual review of the 2011 jurisprudence on insurances matters on February 22, 2012 with members of the Canadian Insurance Claims Manager Association (CICMA). The presentation was held at the VIP Centre of the 1000 de la Gauchetière in Montreal and more than 60 participants were present.

Pierre Denis, Benjamin D. Gross and Étienne Brassard gave presentations at a Canadian Institute advanced seminar on financing and security on January 25th and 26th at the Omni Hotel Mont-Royal in Montreal.
The objective of this seminar was to help professionals deal with the latest developments in financing and security on property in order to better represent their clients and defend their financial interests. Participants benefited from the expertise of Mr. Denis and Mr. Brassard who spoke of financing and taking security on aircraft and the eventual coming into force in Canada of the Cape Town Convention and of Mr. Gross who spoke about intercreditor agreements.

This presentation took place on Thursday, November 24, 2011 at the Hilton in Montreal and on Tuesday, December 13, 2011 at the Plaza Hotel in Quebec City.

On December 1, Véronique Morin, lawyer at Lavery, was a lecturer for a workshop entitled “Transfert de connaissances en relations de travail et médias sociaux : l’apport d’un groupe de discussion” (The transfer of knowledge in work relationships and social media: the benefits of group discussions), which offered practical exercises in order to show participants the significance of such groups by basing it on social media.
Lavery was a sponsor of this event organized by the Association québécoise d'établissements de santé et de services sociaux (AQESSS).

On December 1, Marc Beauchemin and André Vautour participated in the Canadian Institute’s 2nd conference on regulatory compliance for financial services. Held at the Fairmont Queen Elizabeth Hotel in Montreal, the conference was on the requirements of additional examinations by regulatory authorities.
Mr. Beauchemin and Mr. Vautour’s presentation, called “Gérer les risques inhérents à l’impartition à toutes les étapes de la relation avec le fournisseur” (Managing risks from outsourcing in all the steps of a relationship with a supplier), discussed many factors that represent challenges when outsourcing as well as practical methods to use in an outsourcing agreement.

On November 16 and 17, Dina Raphaël, partner at Lavery, and Nathalie Durocher, lawyer at Lavery, were speakers at the 4th edition of the “Conformité et gestion des risques pour les marchés financiers” conference at the Intercontinental Hotel in Montreal.
Ms. Raphaël and Ms. Durocher’s presentation was called “Changement de culture : ligne directrice proposée par l’Autorité des marchés financiers à l’égard des assureurs en matière de pratiques commerciales” (Change of Culture : Proposed Guidelines from the Autorité des marchés financiers for insurers in regards to commercial practices).
