Mr. Patrick A. Molinari, Legal Counsel at Lavery, spoke at the Canadian Bar Association – Québec Branch’s mini-symposium Les caméras braquées sur nos aînés (cameras focusing in on our elders) held on November 20th at the 1000 de la Gauchetiere Conference Center. Mr. Molinari’s presentation was entitled La télésurveillance des usagers hébergés : la difficile conciliation des droits et des intérêts (Remote Monitoring of Inpatients: the Difficult Conciliation Between Rights and Interests), and covered the main legal issues establishments must take into account with regard to remote monitoring practices. On November 20, Daniel Bouchard, Managing Partner of Lavery’s Quebec City Office and lawyer specialized in the fields of municipal, environmental and administrative law, gave a web conference for the Fédération québécoise des municipalités (FQM) under the theme of “Contract Management Policy: Reminders and Status Report” (Politique de gestion contractuelle : rappels et état de la situation). During his discussion-type conference, Mr. Bouchard moderated a discussion regarding the contract management policy that every municipality must adopt under Article 938.1.2 of the Code municipal (C.M.), or under Article 573.3.1.2 of the Loi sur les cités et villes (L.C.V.). He highlighted which contracts fall under said policy, the minimum measures it must contain, how it must be distributed and the possible sanctions that could be imposed on elected representatives or public officials if the policy is not respected, either under Article 938.4 C.M. or under Article 573.3.4 L.C.V. Mr. Bouchard focused especially on how best to implement such a policy and the requisite monitoring actions. Based on jurisprudence and doctrine, he also discussed policy impact on the wording of municipal contracts and on the content of calls for tender in particular.
On November 25 in Quebec City, Éric Gélinas, Legal Counsel at Lavery, member of the Business Law Group in our Montreal office and specialized in complex tax reorganizations and the fiscal aspects of national and cross-border mergers and acquisitions, gave a workshop on ITA Section 55 and Butterfly Reorganizations for UPA accountants. More than 20 professionals attended the session.
On November 19 in Quebec City, Katia Opalka, a partner at Lavery, gave a talk at a seminar on the mining sector in Scandinavia hosted by Export Québec as part of the Québec Mines conference. Ms. Opalka described the scope of the Canada-European Union Comprehensive Economic and Trade Agreement, the business opportunities it may present in the mining sector, and steps remaining before it takes effect. Patrick A. Molinari is the author of chapter 7, entitled Pratique médicale en établissement (Medical Practice in Institutions), in the collective work Droit et politiques de la santé (The Law and Health Policies) published recently by LexisNexis. In his chapter, Mr. Molinari offers up a detailed analysis of often-overlooked aspects of medical practice in health institutions. His analysis is twofold: he discusses how to gain access to practice in institutions and the terms thereof from the perspective of the obligations to which doctors are subject. The text will remain valid even after the current reform of the healthcare network is implemented.
Yvan Biron of Lavery, a lawyer specialized in environmental law for almost 30 years, reveals, in the winter issue of Montréal centre ville magazine, the creative and visionary paths he traveled in developing a practice that today is fully equipped to reconcile current economic and environmental issues. Ms. Caroline Harnois, a partner in Lavery’s Family Law, Personal Law and Estate Law team, has published a column in the Family Law Bulletin (Bulletin Droit de la Famille, Éditions Yvon Blais) on the Hague Convention of 1980 on the Civil Aspects of International Child Abduction. Ms. Harnois also spoke at a conference on Family Mediation in the Context of Dual Nationality and Long Distance (La médiation familiale dans un contexte de bi-nationalité et à distance) on November 7-8. The conference was organized by the AIFI (Association internationale francophone des intervenants auprès des familles séparées) and the COAMF (Comité des organismes accréditeurs en médiation familiale). Ms. Harnois’ presentation was given jointly with Ms. France Rémillard, Director of Central Authority for Quebec under the Hague Convention, at the Ministry of Justice. Ms. Jocelyne Dahan, a Family Mediator from France and Ms. Lorraine Filion, a social worker and Family mediator, also gave a presentation.
Pierre Marc Johnson, G.O.Q, MSRC, legal counsel at Lavery, took part in a panel at the Fall Meeting of l’Association Nationale France-Canada, which was held on November 21 in Paris. The panel’s theme was « Accords de libre-échange entre le Canada et l’Europe. Quelles répercussions pour la France? » (Canada-EU Free Trade Agreement. What will be the impact in France?) On October 28, 2014, Marie Cossette, a partner at Lavery, gave a conference during the investigations within regulatory bodies portion of the CNNAR (Canadian Network of National Associations of Regulators) Annual Conference; representatives of member organizations from across Canada attended the conference. Ms. Cossette’s topic was regulatory investigator testimony and proper preparation for investigator cross-examination during disciplinary hearings. Ms. Amélie Bélisle, associate, practising in Lavery’s Labour and Employment Law Group, will conduct a workshop on employer obligations regarding mental illness accommodations during the 7th edition of Les Affaires’ Conference on Mental Health and Well-Being at Work (Santé psychologique et mieux-être au travail), next January 20th. Marie Cossette was a session speaker at The Canadian Institute’s conference La lutte contre la corruption au Québec, au Canada, aux États-Unis et à l’étranger (Anticorruption in Quebec, Canada, the US and Abroad) held in Montreal on October 29th, 2014. During her presentation, Ms. Cossette discussed ways to identify red flags and tag risks depending on the business field, of the location where it carries out its activities and of the scope of its interaction with local government authorities. She also spoke about internal due diligence programs, the necessity to adapt when the risk potential changes and how best to evaluate situations where excessive compensation is demanded by third parties. Jean-Philippe Turgeon, a Partner at Lavery and leader of our Franchising and Distribution Section, spoke at the 4th Edition of the Conseil québécois de la franchise’s Symposium, on November 13, 2014. The symposium’s theme was “Best Practices and Recent Jurisprudence in Franchising” (« Meilleures pratiques et jurisprudence récente en franchise ») and was a great success. Mr. Turgeon’s conference was entitled “Ethics and Best Practices for Franchisor: Essential to Maintain Growth in the Franchising Industry” (« L’éthique et les bonnes pratiques du franchiseur : impératif pour maintenir la croissance de l’industrie de la franchise »).
