On October 25, in conjunction with Déry Barrette, a claims adjustment firm, Lavery held its annual conference on recent developments in damage insurance at the Delta Sherbrooke Hotel. Frédérick Breton and Jonathan Lacoste-Jobin, respectively a lawyer and a partner in the Litigation and Conflict Resolution Group, summarized significant decisions handed down over the past year in property and casualty insurance.

Léonie Gagné and Jonathan Lacoste-Jobin presented a conference intitled “Practical advice to claim adjusters : from the loss to the trial”
On May 11, Léonie Gagné and Jonathan Lacoste-Jobin, respectively an associate and a partner from our Litigation and Dispute Resolution Group presented a seminar to claim adjusters from Cuierrier & Associés and select clients at the Le Mirage Golf Club in Terrebonne. Entitled “Practical advice to claim adjusters: from the loss to the trial”, the seminar provided claim adjusters with advice to assist them when investigating and recovering indemnities paid by the insurer as well as with the insured’s defense. The conference covered among other subjects the drafting a reservation of rights letter, notices that can be sent by claim adjusters, a review of the new Code of Civil Procedure, and an overview of related decisions.

Jonathan Lacoste-Jobin et Bernard Larocque, partners of our Litigation and Dispute Resolution Group, presented the 2016 review of insurance law jurisprudence at the Chambre de l’assurance de dommages (ChAD) on February 21 and at the Canadian Insurance Claims Manager Association (CICMA)on February 23. These two events, which brought together more than 60 attendees, highlighted the 2016 key decisions in the field of insurance law.

On February 8 and 9, 2017, Jonathan Lacoste-Jobin and Bernard Larocque, partners and members of the Litigation and Dispute Resolution Group, presented the 2016 annual review of insurance law jurisprudence. The presentation took place in our Montreal office as our Québec City and Sherbrooke offices joined through video-conference. This event brought together over 150 attendees where our speakers summarized and exchanged on the main judgments rendered in Quebec during the year 2016.

On January 31, 2017, Jonathan Lacoste-Jobin and Bernard Larocque, partners of our Litigation and Dispute Resolution Group, presented the 2016 review of insurance law jurisprudence at the Jean Bélanger Conference of the Canadian Bar Association, Quebec division (ABC-Quebec). This event, which brought together more than 75 attendees, highlighted the 2016 key decisions in the field of insurance law.

The 2016 edition of Opération Père Noël was a great success at Lavery!
Lavery team’s participation in the 2016 Edition of Opération Père Noël provided gifts to some 228 children from low-income families this past Christmas holiday. Spearheaded in Montréal by Jonathan Lacoste-Jobin, a partner from the firm’s Litigation Group, this annual activity confirms both Lavery's commitment to the community as well as its role as a corporate citizen. Founded in 1995, Opération Père Noël is a not-for-profit organization which allows deprived children to receive gifts during the holiday season. Opération Père Noël has acknowledged Lavery’s continued presence in the community by recognizing the firm as a “collaborateur corporatif”.

Jonathan Lacoste-Jobin and Léonie Gagné publish an article in La ChADPresse
Jonathan Lacoste-Jobin, partner, and Léonie Gagné, lawyer, have published an article entitled “Une cueillette d’information approfondie peut porter ses fruits” (“Thorough information gathering can bear fruit”) in the Winter 2016 edition of La ChADPresse. In the article, they discuss the key elements that can justify the ab initio cancellation of an insurance policy. A recent Superior Court decision in Laporte c. Intact, compagnie d’assurances shows that an in-depth investigation by the claims adjuster can be necessary and useful in obtaining the information required for such an argument.
