  5. Lavery announces appointment of Simon Clément as managing partner of its Québec City office

    Lavery is pleased to announce the appointment of Simon Clément as managing partner of Lavery’s Québec City office. In addition to managing Lavery’s Québec City office, comprised of 44 professionals and employees,Mr. Clément will be responsible for the overall growth of the firm’s activities and the firm’s position in the Québec City area. As such, he will be joining the firm’s Management Committee. A professional known in the business community for his expertise and drive Mr. Clément’s practice extends to commercial litigation, including shareholder conflicts, corporate reorganizations and insolvency, breach of contract and urgent proceedings. He also offers legal counsel to long-term clients for acquisitions as well as sales of businesses and assets, in particular. In keeping with this, he chairs the Québec City division of the M&A Club, founded in 2012 to facilitate deal making and financing in the mid-market private sector between M&A professionals. “Lavery is more than a century old and has strong roots in Québec City.   7. A Lavery team to train members of the COMBEQ in 2018 on wetland issues

    Throughout 2018, Daniel Bouchard, a partner, along with Valérie Belle-Isle, Chloé Fauchon and Pier-Olivier Fradette, associates of the Public and Administrative Law group, will train members of the Corporation des officiers municipaux en bâtiment et en environnement du Québec (COMBEQ). The seminar is entitled “Milieux humides et hydriques et certificat d’autorisation : quel rôle pour les municipalités ?” and is intended primarily for environmental municipal officers, as well as other municipal workers. It deals with the practical impact of Bills 102 and 132 adopted in 2017 respecting the conservation of wetlands and bodies of water. The training will be offered to all municipalities in the province and will be delivered in 24 cities over the course of the year.

  8. Lavery holds a seminar on the impact of recent amendments to the Environment Quality Act on the work of environmental consultants

    Lavery held a seminar on the impact and extent of recent amendments to the Environment Quality Act (EQA) on the work of consultants. The seminar was held on November 8 at the Lavery Conference Centre in Montréal. Environmental consultants listened to presentations by Daniel Bouchard and Chloé Fauchon, respectively a partner and a lawyer of the Public and Administrative law group, on amendments to the EQA that expanded the right to access authorization certificates granting the Minister the power to stop an activity without compensation and immunity from liability, except in cases of gross or intentional fault. They discussed these themes in light of the recent case law on the state’s liability in environment matters and offered practical suggestions to consultants on how to protect themselves given the changes.

  9. Lavery represents Aspen Skiing Company and KSL Capital Partners in a US$1.5 billion acquisition

    As legal advisors for the Quebec portion of the transaction, Lavery represented the affiliates of Aspen Skiing Company, LLC and KSL Capital Partners, LLC during the acquisition of Intrawest Resorts Holdings, Inc., a ski resort operator and adventure company in North America that owns Mont Tremblant Resort in Quebec. The transaction closed on July 31, 2017, for an approximate aggregate value of US$1.5 billion and created a new entity with a property portfolio of 12 four-season mountain resorts, 20,000 skiable acres, significant land available for real estate development, and Canadian Mountain Holidays, a leading heli-ski operator. The Lavery team was headed by Sébastien Vézina and François Arseneault (Corporate) and included Carole Gélinas and Mathieu Cantin (Real Estate), Audrey-Julie Dallaire and Daniel Bouchard (Environment), Zeïneb Mellouli (Labour), Eric Lavallée (Intellectual Property) and Maxime Rousseau-Turenne and Luc Thibaudeau (Litigation).

    Daniel Bouchard, Managing Partner of the Québec City office and Chloé Fauchon, a lawyer of the Public and Administrative Law group, spoke at Les développements récents en droit de l’environnement, a conference on recent developments in environment law organized by the Barreau du Québec and held on June 2, 2017, at the Palais des congrès de Montréal. They reviewed the recent jurisprudence on environment law and commented on the effects and scope of Bills 102 and 132, in particular the notion of watercourse, the civil liability of the Minister of the Environment in the exercise of his duties, and the procedure for obtaining an authorization certificate in an emergency.

    Daniel Bouchard, Managing Partner of the Quebec City office, spoke at a meeting of the Réseaux Experts/Développement durable organized by the Manufacturers and Exporters of Quebec (MEQ), held on April 21 at the Agropur head office in St-Hubert. He pointed out to MEQ members the repercussions for Quebec businesses of Bill 102, An Act to amend the Environment Quality Act to modernize the environmental authorization scheme and to amend other legislative provisions, in particular to reform the governance of the Green Fund.

  12. Les Vergers Leahy wins its case vs. UPA and CPTAQ

    Les Vergers Leahy, represented by Daniel Bouchard, have won a major victory after a 14-year legal saga against the Fédération de l’UPA and the Commission de protection du territoire agricole du Québec (CPTAQ).  The Tribunal administratif du Québec authorizes a water drawing project for bottling in an agricultural zone.
