  2. Jean-Philippe Turgeon and Stéphanie Destrempes publish an article in the IBA-International Franchising Newsletter

    Mr. Jean-Philippe Turgeon and Ms. Stéphanie Destrempes of Lavery’s Franchising and distribution group wrote an article in the September 2015 issue of the International Franchising Newsletter of the International Bar Association Legal Practice Division presenting a comparative overview of the application of the implied duty of good faith in franchise agreements in Quebec, following the Dunkin Brand case, and in the rest of Canada and abroad, including the United States, France, United Kingdom and Australia, where franchise is a significant area of the industry.   3. Jean-Philippe Turgeon, speaker at the International Bar Association Annual Conference

    Jean-Philippe Turgeon, partner at Lavery and head of the Franchise and distribution group, will take part of a panel on the topic “The age-old question – applicable law and jurisdiction in franchising, commercial agency and distribution agreements” hosted by the International Bar Association (IBA) 2015 Annual Conference held in Vienna (Austria) from October 4th-9th 2015. In a nutshell, the panel will discuss the local enforcement of foreign courts judgments and foreign arbitral awards resulting from governing law, jurisdiction and arbitration clauses, as the case may be.   4. Jean-Philippe Turgeon and Guillaume Synnott, authors of an article in Canadian Business Franchise

    Mr. Jean-Philippe Turgeon and Mr. Guillaume Synnott, a Franchise and Distribution Law partner and associate at Lavery respectively, are the authors of an article entitled “Takeaways from the Dunkin’s Donuts Decision” published in the September 2015 issue of Canadian Business Franchise. In their article, Mr. Jean-Philippe Turgeon and Mr. Guillaume Synnott highlight the recent Dunkin’ Donuts judgment from the Court of Appeal of Quebec which clarifies the extent of the contractual implicit obligations of the franchisors toward their franchisees, such as the franchisor’s obligation to take reasonable measures in order to protect and enhance its brand and franchise system.   5. Jean-Philippe Turgeon, speaker at the International Franchise Expo

    On June 19, 2015, Jean-Philippe Turgeon, partner at Lavery and head of the Franchise and distribution group, will be a speaker at the International Franchise Expo which will take place in New York. His conference, entitled “The ABC’s of a successful franchise expansion in Quebec”, will present an analysis of the franchise industry in Quebec, discussing the best practices for the successful expansion of a franchise system in the province, the legislative particularities and its impacts, the contractual context for conceivable development, as well as the implications of Quebec culture on the concept’s adaptation and trademark name.

    Mr. Jean-Philippe Turgeon and Ms. Stéphanie Destrempes of Lavery’s Franchising and Distribution practice group have published an article entitled ‘Franchising in Canada: A Duality of Laws and Culture’ in 2014/2015 edition of the Lexpert®/Canadian Corporate Counsel Association’s (CCCA) Directory and Yearbook.   7. Jean-Philippe Turgeon of Lavery – Speaker at the 4th Edition of the Conseil québécois de la franchise’s Symposium

    Jean-Philippe Turgeon, a Partner at Lavery and leader of our Franchising and Distribution Section, spoke at the 4th Edition of the Conseil québécois de la franchise’s Symposium, on November 13, 2014. The symposium’s theme was “Best Practices and Recent Jurisprudence in Franchising” (« Meilleures pratiques et jurisprudence récente en franchise ») and was a great success. Mr. Turgeon’s conference was entitled “Ethics and Best Practices for Franchisor: Essential to Maintain Growth in the Franchising Industry” (« L’éthique et les bonnes pratiques du franchiseur : impératif pour maintenir la croissance de l’industrie de la franchise »).
