Mediation and Arbitration

Overview

Lavery offers mediation services to parties wishing to use private dispute resolution methods in matters involving civil and commercial law, family law, personal law, and estate law. Some of our experienced professionals also act as arbitrators.

Our mediators and arbitrators have many years’ experience in litigation and dispute resolution, are accredited by the Barreau du Québec and recognized by the Institut de médiation et d’arbitrage du Québec (IMAQ) and the ADR Institute of Canada (ADRIC).

Services

Our mediators help parties engage in dialogue to identify their differences, needs, and interests while exploring possible solutions with a view to reaching a mutually satisfactory agreement, either prior to or after the initiation of legal proceedings.

Based on the difficulties inherent to specific disputes, their complexity, and the issues involved, parties are sometimes well advised to use a mediation process that is confidential, without prejudice, and carried out in a more comfortable and relaxed atmosphere than before the courts.

To make the process as accessible as possible, professional fees are based on a sliding scale in accordance with the amounts involved. Our services include all organizational aspects of the mediation; its preparation, the sessions themselves, and the necessary follow-up once the parties have reached an agreement.

In Montréal, mediation and arbitration sessions are held at the Lavery conference centre on the 40th floor of Place Ville-Marie in spacious and comfortable conference rooms equipped with state-of-the-art technology. They may also be held in our offices in Quebec City, Sherbrooke or Trois-Rivières, as requested by the parties.
