Sylvie Demers is a member of the firm’s Litigation group, more specifically in Family Law, Personal Law and Estate Law. Her practice covers all matters relating to family, personal and estate law, in particular divorce, separation from bed and board, separation of de facto couples, child custody, child support, partition of property, name changes, grandparents’ rights of access to their grandchildren, institution of protective supervision, homologation of mandates and estate litigation.
In recent years, she has led or worked on a several cases involving complex legal issues, many of which contained private international law components, such as international lis pendens, or issues such as relocating a parent abroad, division of property situated abroad, or treatment of trusts in the partition of family patrimony. She has also developed extensive experience in financial litigation, including specific issues that can arise during a divorce or separation at retirement and in litigation with respect to succession and the protection of vulnerable persons.
Ms. Demers represents and advises her clients on both hotly contested issues before the courts and on their needs when negotiating settlements out of court. Her legal and procedural knowledge contributes to handling her clients’ cases efficiently. In addition to representing them, she helps and advises her clients with respect to the law, procedures and strategic decisions that are required at every stage of their case to ensure that their rights are respected, and that their goals are achieved.
Her litigation practice has led her to appear before the Superior Court of Québec and the Court of Appeal of Quebec.
Ms. Demers is thorough and skilled at representing her clients and preparing her interventions before the court. She approaches cases and issues with an open mind, creativity, innovation and fairness while respecting the rule of law to propose practical and effective solutions to the various problems her clients are encountering.
As litigation in family law, personal law and estate law is often very difficult for those living it, Ms. Demers wants to provide her clients with steady support, while focusing on results. She opts for a conciliatory approach to do so and explores out-of-court settlements with her clients whenever possible, both before and during the judicial process.
Ms. Demers was on the Dean’s Honour Roll during her studies at the Faculty of Law of Université de Montréal and on the Honour Roll of the Faculty of Graduate Studies of Université Laval for her Master of Public Communication.
